At Rao for Us, we work to support Steve Rao. This Privacy Policy is designed to help you understand how Rao for Us (“the Campaign,” “we,” “our,” “us”) collects, uses, and shares your personal information.‍ ‍

1. SCOPE

This Privacy Policy applies to personal information processed by us, including on our websites, applications, and other online or offline offerings. To make this Privacy Policy easier to read, our websites, applications, and other offerings are collectively called the “Services.” ATTENTION: PLEASE READ OUR PRIVACY POLICY CAREFULLY BEFORE ACCESSING OR USING THE SERVICE. ACCESSING OR USING THE SERVICES INDICATES THAT YOU ACCEPT AND AGREE TO BE BOUND BY THIS PRIVACY POLICY IN FULL. IF YOU DO NOT ACCEPT THIS PRIVACY POLICY, DO NOT ACCESS OR USE THE SERVICES. By continuing to use our Services, you acknowledge that You have read and understood this Privacy Policy and agree to information described herein.

2. PERSONAL INFORMATION WE COLLECT

The categories of personal information we collect depend on how you interact with us, our Services, and the requirements of applicable law. We collect information that you provide to us, information we obtain automatically when you use our Services, and information from other sources such as third-party services and organizations, as described below.

A. Information You Provide to Us Directly

We may collect the following personal information that you provide to us.

  • Donations. We may collect personal information when you make donations, including name, email address, and cell phone. State law also requires us to use our best efforts to collect certain employment information, including your occupation and name of employer if your contributions exceed $50 in an election cycle. Your donations are processed by a third-party payment processor through our online fundraising platform NationBuilder. We do not directly collect or store any payment card information entered through our Services, but we will receive information associated with your payment card information, as described above.

  • Your Communications with Us. We may collect personal information, such as name, email address, phone number, or mailing address when you contact us through the Services, apply for a job, or otherwise communicate with us.

  • Social Sharing Features. We and others who use our Services may collect personal information that you submit or make available through our interactive features (e.g., social media pages). Any information you provide using the public sharing features of the Services will be considered “public,” unless otherwise required by applicable law, and is not subject to the privacy protections referenced herein. For more information about the purpose and scope of data collection and processing in connection with social sharing features, please visit the privacy policies of the entities that provide these features.

  • Strategic Partnerships. We may collect personal information from individuals and third parties to assess and pursue potential strategic partnerships.

  • Volunteer Applications. We may post volunteer openings and opportunities on our Services. If you reply to one of these postings by submitting your application, CV and/or cover letter to us, we will collect and use your information to assess your qualifications.

‍B. Information Collected Automatically

We may collect personal information automatically when you use our Services:

Automatic Data Collection. We may collect certain information automatically when you use our Services, such as your Internet Protocol (IP) address, user settings, MAC address, cookie identifiers, mobile carrier, mobile advertising and other unique identifiers, browser or device information, location information (including approximate location derived from IP address), and Internet Service Provider. We may also automatically collect information regarding your use of our Services, such as pages that you visit before, during and after using our Services, information about the links you click, the types of content you interact with, the frequency and duration of your activities, and other information about how you use our Services.

Cookies, Pixel Tags/Web Beacons, and Other Technologies. We, as well as third parties that provide content, advertising, or other functionality on our Services, may use cookies, pixel tags, local storage, and other technologies (“Technologies”) to automatically collect information through your use of our Services.

Cookies. A cookie is a small file containing a string of characters that is sent to your computer when you visit a website or use an online service. When you visit the website or use the online service again, the cookie allows that website or online service to recognize your browser or device. Cookies may store unique identifiers, user preferences and other information.

  • Pixel Tags/Web Beacons. A pixel tag (also known as a web beacon) is a piece of code embedded in our Services that collects information about engagement on our Services. The use of a pixel tag allows us to record, for example, that a user has visited a particular web page or clicked on a particular advertisement. We may also include web beacons in e-mails to understand whether messages have been opened, acted on, or forwarded.

  • Duration of Cookies: We may use “session cookies” or “persistent cookies.” Session cookies are temporary and expire once you close your browser or once your session ends. Persistent cookies remain on your device for much longer or until you or your browser erases them. Persistent cookies have varying durations that are dependent on their expiration date.

  • How do I control cookies: Web browsers allow some control of most cookies through the browser settings. Most mobile devices also offer settings to reject mobile device identifiers. Although users are not required to accept cookies or mobile device identifiers, blocking or rejecting them may prevent access to some features available through the Services or impair the functionality of the Services. To find out more about cookies, including how to manage and delete cookies, visit www.aboutads.info/choices. You can also opt-out of interest based advertising from participating members by visiting http://www.networkadvertising.org/choices/.

‍Our uses of these Technologies fall into the following general categories:

  • Operationally Necessary. These cookies are strictly necessary to make our Services function properly. This includes Technologies that allow you access to our Services, applications, and tools that are required to identify irregular website behavior, prevent fraudulent activity and improve security or that allow you to make use of our functionality;

  • Performance-Related. We may use Technologies to assess the performance of our Services, including as part of our analytic practices to help us understand how individuals use our Services (see Analytics below);

  • Advertising- or Targeting-Related. We may use first party or third-party Technologies to deliver content, including ads relevant to your interests, on our Services or on third-party websites. These cookies track visitors across websites and collect information to provide customized ads.

By submitting, uploading, posting, emailing, texting, or otherwise providing User Content to the Campaign, you grant Rao for Us and those acting on its behalf, including its employees, contractors, consultants, service providers, and affiliated committees, a worldwide, non-exclusive, perpetual, irrevocable, royalty-free, sublicensable license to use, copy, reproduce, publish, distribute, display, perform, modify, adapt, translate, and otherwise use your User Content in connection with the Campaign's activities, communications, and operations, in any media or format now existing or developed in the future, without additional notice or compensation to you.

You acknowledge that User Content you voluntarily make public or submit for publication may be viewed, shared, or redistributed by others, and, to the extent permitted by law, you release the Campaign and its authorized representatives from claims arising from the authorized use of your User Content under these Terms.

You may submit only User Content that you own or have sufficient legal rights to provide. By submitting User Content, you represent and warrant that your submission does not infringe the rights of any third party, violate any applicable law, or breach any agreement or obligation owed to another person or entity.

The Campaign is not required to review, monitor, publish, or retain User Content. We reserve the right, in our sole discretion and without prior notice, to refuse, remove, edit, or disable access to any User Content that we believe violates these Terms, may expose the Campaign or others to legal or operational risk, or is otherwise inappropriate.

Ownership and Limited License

The Site, including the text, graphics, images, photographs, videos, illustrations and other content contained therein, are owned by the Campaign or our licensors and are protected under both United States and foreign laws. Except as explicitly stated in these Terms, all rights in and to the Site are reserved by us or our licensors. You understand that the Campaign may treat Feedback as nonconfidential.

Repeat Infringer Policy and Copyright Complaints

The Campaign respects the intellectual property rights of others and expects users of the Site to do the same. Consistent with the Digital Millennium Copyright Act (“DMCA”) and other applicable laws, the Campaign may suspend or terminate, where appropriate, the access or accounts of users who repeatedly infringe the intellectual property rights of others.

If you believe that material available on the Site infringes a copyright you own or are authorized to enforce, you may submit a written notice to the Campaign’s designated contact:

Attn: Steve Rao
Address: PO Box 8, Morrisville, NC 27560
E-Mail Address: ‍info@raoforus.com ‍

Your notice should include the information required by the DMCA, including the elements described in 17 U.S.C. § 512(c)(3). Please be aware that knowingly submitting a false or materially misleading infringement claim may subject you to liability under applicable law.

Third-Party Content, Products, and Sites.

We may provide information about third-party organizations, events, products, services, or activities, or we may allow third parties to make their content and information available on or through the Site (collectively, “Third-Party Content”). We provide Third-Party Content as a service to those interested in such content. Your dealings or correspondence with third parties and your use of or interaction with any Third-Party Content are solely between you and the third party. The Campaign does not control or endorse, and makes no representations or warranties regarding, any Third-Party Content, and your access to and use of such Third-Party Content is at your own risk.

Indemnification

To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Rao for Us, its officers, directors, employees, volunteers, consultants, contractors, service providers, affiliated committees, successors, and agents (collectively, the “Indemnified Parties”) from and against any claims, liabilities, damages, losses, judgments, settlements, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to:

  • Your access to or use of the Site;

  • Any User Content, Feedback, or other materials you submit to the Campaign;

  • Your violation of these Terms or any applicable law; or

  • Your infringement or alleged infringement of the rights of any person or entity, including intellectual property, privacy, publicity, or other legal rights.

If an indemnified claim arises, you agree to cooperate with the Campaign in the defense of the matter, including providing information and assistance reasonably requested. The Campaign reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and you agree not to settle any such claim without the Campaign’s prior written consent where the settlement would impose any obligation or admission on an Indemnified Party.

Dispute Resolution and Binding Arbitration

We hope to resolve any concerns quickly and fairly. If you have a question, complaint, or dispute relating to the Site or these Terms, you agree to first contact the Campaign and make a good-faith effort to resolve the matter informally before initiating legal proceedings.

If a dispute cannot be resolved informally within thirty (30) days after written notice is received, either party may require that the dispute be resolved through binding arbitration administered by JAMS rather than in court, except for claims that may properly be brought in small claims court or claims seeking temporary or preliminary injunctive relief.

Any arbitration shall be conducted in accordance with the JAMS Streamlined Arbitration Rules and Procedures (“JAMS Rules”), unless the parties agree to a different arbitration provider. The most recent version of the JAMS Rules are available on the JAMS website and are hereby incorporated by reference. You either acknowledge and agree that you have read and understand the JAMS Rules or waive your opportunity to read the JAMS Rules and waive any claim that the JAMS Rules are unfair or should not apply for any reason.

In the event the parties agree to a different arbitration provider, the arbitration will be conducted before a single neutral arbitrator in Wake County, North Carolina, unless the parties agree to another location or applicable law requires otherwise.

Each party will be responsible for its own attorneys’ fees and costs unless the arbitrator determines otherwise under applicable law or the parties agree otherwise. The arbitrator may award any remedy available under applicable law but may not consolidate the claims of multiple parties or preside over any class, collective, or representative proceeding.

To the fullest extent permitted by law, you and the Campaign agree that any arbitration or legal proceeding arising from these Terms or your use of the Site will be conducted only on an individual basis. Neither party may bring or participate in a class action, class arbitration, or other representative proceeding.

You and the Campaign agree that these Terms affect interstate commerce and that the enforceability of this Section will be substantively and procedurally governed by the Federal Arbitration Act, 9 U.S.C. § 1, et seq. (the “FAA”), to the maximum extent permitted by applicable law.

Subject to the FAA, these Terms, the applicable JAMS Rules or the rules of another arbitration provider mutually agreed upon by the parties, the arbitrator shall have the exclusive authority to decide all procedural and substantive issues relating to any Dispute, including questions regarding the interpretation, applicability, enforceability, or arbitrability of this arbitration provision. The arbitrator may also award any remedy that would otherwise be available in a court of competent jurisdiction.

If any portion of this section is determined to be unenforceable, the remaining provisions shall continue in full force and effect to the maximum extent permitted by law.
